The Life You Save May Not Be Your Own Abstract: This paper points out an ambiguity in Cass Sunstein’s recent work concerning whose lives and interests are to be promoted by libertarian paternalism, and argues that this ambiguity stems from a lack of clarity regarding how we should understand the relevance of the heuristics and biases literature for democratic theory. The paper attempts to extract from Sunstein’s work an account of how we should go about identifying biases in social choices.
