EU Initiative on Modernization of Trade Defence Instruments COMMENTARY Michael Lux* The Directorate General Trade of the EU Commission has initiated a public consultation on modernizing the EU Trade Defence Instruments (in particular of the AntiDumping Regulation and the Anti-Subsidy Regulation) by means of a questionnaire (http://trade.ec.europa.eu/ doclib/press/index.cfm?id=794) and has published a study elaborated by external consultants (http:// trade.ec.europa.eu/doclib/docs/2012/march/ tradoc_149236.pdf). This commentary addresses some of the key points at issue in the process. On the occasion of a conference held on 10 May 2012 in Brussels the study, the questionnaire and possible legislative amendments were presented by DG Trade and were the subject of comments from trade associations and attorneys active in the foreign trade sector. The study contains a vast amount of information and it is of both practical and academic interest. Of particular interest are the contemplated amendments to the Anti-Dumping Regulation (respective amendments of the Anti-Subsidy Regulation are also contemplated in many cases).1 On this topic it is also important to note that the forthcoming amendment of the Anti-Dumping Regulation ­ namely the adaptation to the Lisbon Treaty and the comitology regulation (Regulation No. 182/2011) ­ is already being discussed within the Council and the Parliament.
