Based on the recent clarification of the European Court of Human Rights (ECtHR),1 the question of mandatory vaccination is still the subject of intensive debate.2 These questions concerning human rights mainly concern the possibility of restrictions, especially concerning the principle of proportionality. In parallel, however, the question of human obligations is increasingly being discussed, or in the diction of the ECtHR, the question of ‘social solidarity’.3 The current health crisis affects all of Europe and, of course, beyond. The European Union (EU) has developed from a vehicle of economic integration, into a political Union (Maastricht Treaty), also embracing human rights (from the 1969 case Stauder to the CFR). The Lisbon Treaty finally has also turned this integration process into a ‘Union of Values’. These values also comprise solidarity.During the current health crisis, many people have claimed that various fundamental (or human) rights have been abolished, or at least illegally restricted, ranging from the freedom of speech, freedom of assembly, to the right to integrity, respectively, the right to private life.
