National Labor Relations Board Internal union affairs — membership privileges — crossing picket lines HEADNOTES Facts The collective agreement between the union and employers requires all bargaining unit employees to be union members in "good dues standing". A benefit provided by the employers to bargaining unit employees is health insurance that includes 90% reimbursement for the cost of prescription drugs and certain eye and dental care benefits. The union operates a non-profit pharmacy that accepts the amount paid by the health insurance plan in full payment for drugs purchased by union members. It also operates dental and eye care clinics that bill union members only for the small difference between the insurance benefits and the cost of services. Non-union members must pay cash for the full cost of drugs and services at the pharmacy and clinics. When the union called a strike during efforts to obtain a new collective agreement, a large number of employees notified the union that though they would pay dues to the union, they would not be bound by membership obligations and continued to work during the strike.
