Restraint of trade clause - effect of agreed termination of employment. HEADNOTES Facts Van Drongelen entered into service with Evro Hol- land (a private employment agency) on 1 May 1967. The parties agreed upon a restraint of trade clause in the following terms: "Van Drongelen is prohibited within a period of three years after the termination of the contract of employment from establishing, running, join in running, or causing to run, directly or indirectly, a business identical, similar or related to that of Evro Holland within a circle with the Anna Paulownastreet in the Hague as the central point and with a radius of 25 kilometres; he is also prohibited from having a financial interest in such a business in whatever form, directly or indirectly. The employee is furthermore prohibited within a period of one year after the termination of the con- tract of employment from working in one way or another in a business identical, similar or related to that of Evro Holland, be it for payment or other- wise, within a circle with the Anna Paulownastreet in the Hague as central point and with a radius of 25 kilometres.
