SWEDEN Individual employment relationship - permissibility of alcohol and drug testing HEADNOTES Facts The case concerns a claim under the collective agreement between the Employers' Association of Power Companies (EFA) and the Swedish Elec- tricians Trade Union (SEF) - the so-called Power Plant Agreement. SEF has lodged a claim contending that its member, Inga-Lill, employed as a cleaner, is not liable to take alcohol and drug tests every third year at OKG's nuclear power station in Simpevarp located on the Swedish east coast. OKG entered into an agreement in 1993 with three other union organisations concerning obligatory drug testing for the members of the trade union organisations at the nuclear power station. SEF refused to sign such an agreement. In 1994 OKG decided that drug testing should apply to all the employees of the nuclear power station, including those employed by contracting companies. Tests performed by the company concerning the presence of drugs cover only cannabis. The obligation of the employees to take drug tests as well as the performance of tests itself follows from instructions issued by OKG, enti- tled 'Our View of Alcohol and Drugs'.
