I. LITIGATION: THE COURT SYSTEM IN SAUDI ARABIA The proponents of arbitration number amongst its advantages, speed, expertise, discretion and cheapness. Before discussing whether arbitration under the Saudi Arabian Arbitration Regulations indeed offers these attractions, I want to consider briefly with you the courts in Saudi Arabia before which a dispute which might otherwise be settled by arbitration is most likely to be heard. I al;<o wish to reflect why arbitration may ostensibly appear to be an attractive alternative to proceedings before those courts. The judicial system in Saudi Arabia is comprised of a number of courts or committees with sometimes overlapping jurisdictions. For the purposes of a comparison of the relative merits of arbitration and litigation the most important of these are: the Sharia Courts, the Grievance Board, the Committee for the Settlement of Commercial Disputes, the Commercial Papers Committee and the Labour Committees.
