Leto Cariolou * Recent Case Law of the European Court of Human Rights Concerning the Protection of Minorities I. Introduction Th is paper is an overview of the case law of the European Court of Human Rights con- cerning the treatment of members of minorities that was delivered between December and February . It is important to note that the European Convention on Human Rights does not contain any specifi c provisions on the protection of minori- ties, unlike Article of the International Covenant on Civil and Political Rights. It does however guarantee individual rights whose eff ective protection is essential for the preservation of the distinctiveness and development of minority groups. It also prohibits in its Article any form of discrimination in the enjoyment of the rights and freedoms recognized in the Convention on grounds that include discrimination on the basis of association with a national minority. Th e defi nition of ‘minorities’ falls outside the scope of this paper. Th e paper will deal with issues concerning members of groups that have experienced discrimination by the state or its citizens because of their ethnic, national, racial, religious or linguistic characteristics.
