INTRODUCTION . The European Community does not have its own punitive power, because in this respect the Member States have not given up their national sovereignty.2 Nevertheless, Community law contains numerous sanctions,3 which can be qualified as penal law sanctions in a broader sense.4 For this reason - according to the adjudication of the Court of Justice of the European Community, 125 the European Court of Human Rights6 as well as the German Federal Con- stitutional Court7 - they underlie the penal principals.8 Until now, however, a codification of 1.
