Abstract

281 Through his chapter on law and legal institutions Sang Hyon Song has rendered an invaluable service to all foreigners having dealings with South Korea. In a succinct narrative, he describes South Korean court structure, the functions and place of judges and lawyers in Korean society, the new Constitutional Court and its role in judicial review, the essence of criminal and civil law, the relationship between law and business, and alternative conflict-resolution mechanisms such as arbitration, media- tion and conciliation. Above all, he provides the cultural context within which South Korean legal norms and institutions operate. In sum, Song's chapter is the best English-language introduction to South Korean law that I have seen to date. A similar chapter on North Korea should enhance the value of Korea Briefing next year. "Bitter Friendship" is the title that Donald Clark chose for his analysis of anti- Americanism in South Korea. He reflects on its causes and puts it in sound historical perspective. In tracing the evolution of the hard-core variety of anti-Americanism, he sketches a four-step progression in Korean images of America since the beginning of U.S.-Korean relations: America the Historic Helper, America the Careless Colossus, America the Ailing Giant
