ITALY Freedom of association – violation Article 11 The right of freedom of association was of such importance that it could not undergo an unspecified limitation, even for a candidate for public office, insofar as the interested person did not do a reprehensible act except by membership in an organisation. In a judgment delivered on 2 August 2001 in the case of Grande Oriente d’Italia de Palazzo Giustiniani v. Italy , the European Court of Human Rights held unanimously that there had been a violation of Article 11 (freedom of association) of the European Convention on Human Rights. Under Article 41 (just satisfaction) of the Convention, the Court held that the finding of a violation constituted sufficient just satisfaction for damage suffered by the applicant association and awarded 10 , 000 , 000 Italian lire (ITL) for costs and expenses. This judgment is not final. Pursuant to Article 43 , Section 1 of the Convention, within three months from the date of the judgment of a Chamber, any party to the case may, in exceptional cases, request that the case be referred to the Grand
