It was this publication that brought me to write the article which under the title "La stipulation a-t-elle degenere?" is found on p. 409 of this number of our review. The subject having been treated there extensively, this compte-rendu may be limited to a few observations only. Mr. Beinart, professor of Roman Law in the University of Cape Town, has found among the manuscripts of his predecessor Mr. Kerr Wylie a complete translation of Riccobono's well known articles which were published under the title Stipulatio ed instrumentum nel diritto giustinianeo in ZSSt. 35 (1914) p. 214---305 and 43 (1922) p. 232-397. This translation was intended to serve in first instance didactic aims and it contained annotations which were mostly of an explanatory na- ture. Prof. Beinart has revised the translation, he omitted the explana- tory notes and added numerous annotations of his own, starting from the idea that the book will be read mainly by advanced students.
