COMPTES RENDUS S. RICCOBONO, STIPULATION AND THE THEORY OF CONTRACT. Translated from the Italian with notes by J. KERR WYLIE, revised and edited with further notes and an introduction by B. BEINART. Balkema, Amsterdam-Cape Town 1957. 239 p. It was this publication that brought me to write the article which under the title "La stipulation a-t-elle degenere?" is found on p. 409 of this number of our review. The subject having been treated there extensively, this compte-rendu may be limited to a few observations only. Mr. Beinart, professor of Roman Law in the University of Cape Town, has found among the manuscripts of his predecessor Mr. Kerr Wylie a complete translation of Riccobono's well known articles which were published under the title Stipulatio ed instrumentum nel diritto giustinianeo in ZSSt. 35 (1914) p. 214---305 and 43 (1922) p. 232-397. This translation was intended to serve in first instance didactic aims and it contained annotations which were mostly of an explanatory na- ture. Prof. Beinart has revised the translation, he omitted the explana- tory notes and added numerous annotations of his own, starting from the idea that the book will be read mainly by advanced students.
