Davey The Sutherland Report takes a relatively close look at the operation of the WTO’s dispute settlement system, and unlike other areas that the report examines, it analyzes and comments on specific proposals to reform the WTO dispute settlement system that are now under discussion in the Doha negotia- tions. After a positive review of the Uruguay Round changes to the system and its overall operation to date, the report considers (i) what it characterizes as the emerging problem of compliance and the possibility of providing for monetary compensation; (ii) how the WTO might respond to criticisms of WTO jurisprudence and (iii) specific reform proposals. As a general proposi- tion, the report takes the view that the system seems to be working well and that changes should be approached cautiously so as ‘to not “do any harm” to the existing system since it has so many valuable attributes’. i. the problem of compliance and possibility of monetary compensation The report in general gives the WTO dispute settlement system high marks.
