AB - If in the notification issued pursuant to Sec. 83(1) of the Patent Act the Patent Court only addresses individual pleas of the plaintiff, the defendant as a rule has no occasion to submit as a precautionary measure, in addition to the alternative petitions that take account of the notification, further alternative petitions relating to pleas that were not addressed by the Patent Court in its notification or that it assessed as having little prospect of success.
