An analysis of the obsolescence and fragmentation of existing legal regimes, the original legislative purpose of the Hague Rules and the Hamburg rules, the initial motivation of the UNCITRAL project, the special function of transport documents and the practical problems encountered in international trade shows that the legislative purpose of uniformity of the law governing the contract for the carriage of goods by sea covered by different transport documents is to enhance the commercial value of transport documents, facilitate international trade and guarantee title to the bailer of the goods. The author accordingly calls for greater attention to the legal effects of the various kinds of transport document. In addition to Tetley’s alternatives, the author emphasises the need for more elaborate rules on document of title effects such as delivery at destination, right of control, delivery, transfer of rights and right of suit. In this way, the reunification of certain rules relating to sea transport documents is probably more feasible.
