INTRODUCTION The introduction of sex education in th e publi c schools of many countries in th e 1960s and '70s ha s given rise to political, pedagogic and religious disputes which have sometimes been very emotional. It may seem odd tha t a subject which has received such growing recognition at the international level should in some countries stir legal controversy and constitutional litigation, but opposition to se x education appears to be motivated by fear that understanding of such matters may lead to promiscuity, by old taboos against open talk on sex, or simply by an attitud e of intolerance. In our view, se x education in public schools in most countries raises few genuin e le­ gal problems and th e question s presented to th e courts are no t diffi­ cult or complicated. A conflict between two civil rights seems to b e inheren t in many of th e case s which appear before the courts: children's basic right to education and knowledge in a vital area of huma n life and parents ' right to control the education of their children.
