'The use of legal power is just one part of comprehensive control programs, and it should remain a last resort', says Dr Edward Campion in the NEJM.l Dr Campion's comment was made in response to the results of a study conducted in New York City, US, where revisions were made to the Health Code in 1993 as part of the city's tuberculosis (TB) control programme. 96% completion rate The revisions allow the commissioner of health to issue orders compelling a person to be examined if TB is suspected, to complete a course of treatment, to receive treatment under direct observation or to be detained while undergoing treatment. The study found that during the 2 year period following the introduction of the revised Health Code, regulatory orders were issued for < 4% of the overall population of> 8000 patients with TB. Less than 2% of the overall population were detained during therapy. The use of regulatory orders for mandatory directly observed therapy or detention resulted in 96% of patients completing treatment.
