This section was added to the Patent Act after India joined the World Trade Organization in 1995. The decision defines the word ‘efficacy’ in the section, which is applicable to chemical inventions in general and drug substances in particular. This is a major case having wide significance to many similar cases pending before the subordinate courts on the application of the s 3(d).
