THE ILC DRAFT ON THE SUCCESSION OF STATES IN RESPECT OF TREATIES: A CRITICAL APPRAISAL by 1. In its 1974 (XXVI) session the International Law Commission conclu- ded, in keeping with its task, the codification of the item " Succession of States in respect of treaties "; it approved thirty-nine draft articles which were then submitted to the United Nations General Assembly. The outcome of the ILC's work, which has lasted from 1968 to the present day, covers only a small part of the " Succession of States and Go- vernments ", a topic singled out, as far back as r 949, as being suitable for codification. On the General Assembly's recommendation, the subject was tackled in 1963 but the problem of succession of governments was laid aside. The problem of succession of States was later sub-divided into three parts: z ) succession in respect of treaties; 2) succession in respect of rights and duties resulting from sources other than treaties; 3) succession in respect of membership in international organizations. The ILC appointed Rapporteurs solely for the first two (Sir Humphrey Waldock and then Sir Francis Vallat for succession in respect of treaties; Mohammed Bedjaoui for succession in respect of matters other than treaties).
