85 AN ECONOMIC CODE FOR THE USSR GER P. VAN DEN BERG Senior Legal Research Officer, Documentation Office for East European Law, University of Leyden Faculty of Law In June 1985, two debates were held concerning the legal position of Soviet enterprises. A meeting of the "bureaus" of the Departments of Philosophy and Law and of Economics of the USSR Academy of Sciences discussed a draft Economic Code. The Learned Council of the Research Institute of Soviet Legislation discussed proposals for amendments in the Principles of Civil Legislation.' I The draft Economic Code is one of the cornerstones for the total reform of economic legislation, which is outdated, too extensive and contains many contradictions. The tutelage of enterprises by means of all kinds of instruc- tions largely restricts any initiatives on their part. One of the aims of the draft Code is to redefine the rights of enterprises according to the principle that they may do everything that is not contrary to law (academician A.E. Egorov).2 According to V.V. Laptev, who already many years ago was a stubborn proponent of an Economic Code, the relations between enterprises and the state agencies responsible for planning and for economic management
