Sampanis and Others v. Greece Right to an effective remedy ­ violation Prohibition of discrimination / right to education ­ violation Article 13 Article 14 + Protocol No. 1, Article 2 Roma children denied access to school before being assigned to special classrooms in an annex to the main primary school buildings. In a judgment delivered on 5 June 2008 in the case of Sampanis and Others v. Greece, the European Court of Human Rights held unanimously that there had been: a violation of Article 14 (prohibition of discrimination) in conjunction with Article 2 of Protocol No. 1 (right to education) to the European Convention on Human Rights, on account of a failure to provide schooling for the applicants' children and of their subsequent placement in special classes because of their Roma origin; and a violation of Article 13 (right to an effective remedy) of the Convention. Under Article 41 (just satisfaction) of the Convention, the Court awarded each of the applicants EUR 6,000 in respect of non-pecuniary damage and EUR 2,000 for costs and expenses.
