ITALY Right to fair trial – violation Article 6, Section 1 Right to an effective remedy – violation Article 13 There was no effective remedy to complain about the excessive length of proceedings in Italy. In a judgment delivered on December in the case of Selva v. Italy , the European Court of Human Rights unanimously held that there had been a viola- tion of Article , Section (right to a fair trial) of the European Convention on Human Rights concerning the right of access to a court and a violation of Article (right to an effective remedy) of the Convention. Under Article (just satisfaction), the Court awarded , euros (EUR) for non-pecuniary damage and EUR , for costs and expenses. This judgment is not final. Pursuant to Article , Section of the Convention, within three months from the date of the judgment of a Chamber, any party to the case may, in exceptional cases, request that the case be referred to the Grand Cham- ber. . Principal facts The applicant, Giacomo Selva, is an Italian national.
