National legal systems consequently confront issues of international law to an unprecedented extent. In view of the limited attention given in the literature of international law to the actual problems encountered by national courts in this respect, an empirical study has been undertaken by the Committee on International Law in National Courts of the International Law Association (ILA). The broad aim of the study was to ascertain the methods by which courts in different states find and apply principles and rules of international law in domestic proceedings. One motivation of the study was, as a follow-up to a suggestion made by the Dutch Branch of the ILA, to explore the potential merit in proposing the possibility of reference by a national court of questions of international law to the International Court of Justice.
