Granatino v Radmacher and its implications for cross-border trusts disputes
Abstract
In Granatino v Radmacher , the Supreme Court delivered a landmark ruling on pre-nuptial agreements in English law. The case is less immediately a decision of profound impact in the international trusts world. The cross-border facts of the dispute, however, resurrected the question of what regard, if any, should be had to foreign law in the English Family Division; and the Supreme Court's conclusions may reverberate around the offshore trusts world.
