Abstract Secure property transactions, certainty of land titling and title transfer are an essential foundation for the economic growth of society. Implementing a system of property title certification is considered a key determinant of economic development. In 2000 the United Nations Human Settlements Programme (UN-Habitat) launched a ‘Global Campaign for Secure Tenure’. Secure and efficient title transfer is not only an essential requirement for developing countries but also for industrialized countries. The international real estate and financial market crisis showed that missing legal control in real estate and mortgage lending transactions and the deficits of land title registers could have serious economic consequences. This paper examines the transfer of property rights on land under private titling and the two existing public titling systems, recording and registration. It shows that the Registration system as part of the System of Preventive Justice is more efficient for the economy. In countries where a legal control in real estate transactions and where efficient public disclosure and registration systems exist, it appears that fraudulent actions such as house-stealing or fake mortgages that have been experienced in ever-increasing numbers in the U.S. are almost non-existent. Résumé Des transactions immobilières sures, et la sécurité des titres de propriété foncière et des titres de transfert sont la base essentielle d’une croissance économique de la société. Mettre en œuvre un système de certification des titres de propriété est considéré comme un élément clef du développement économique. En 2000, le programme des Nations-Unies sur les habitations humaines (UN-Habitat) a lancé une “Campagne mondiale pour la sécurité d’occupation”. Un titre de transfert sûr et efficace n’est pas seulement une condition essentielle pour les pays en voie de développement mais aussi pour les pays industrialisés. La crise internationale des biens immobiliers et des marchés financiers a montré que le manque de contrôle juridique de la propriété immobilière et des prêts hypothécaires et les défauts des registres de propriété foncière pouvaient avoir de sérieuses conséquences économiques. Cet article examine le transfert des droits de propriété sur la terre sous un régime de titres privés et les deux systèmes publics de gestion des titres actuels, la consignation et l’enregistrement. Il montre qu’un système d’enregistrement qui participe du système de justice préventive est plus efficace pour l’économie. Il apparaît que dans les pays où existent un contrôle juridique des transactions immobilières ainsi qu’un système public efficace d’information et d’enregistrement, les actions frauduleuses telles que les vols de maisons ou les fausses hypothèques qui ont eu lieu en nombre toujours plus grand aux États-Unis sont presque inexistantes. Kurzfassung Sichere Eigentumsübertragungen, Zuverlässigkeit von Grundstückstiteln und sichere Übertragung dieser sind eine wesentliche Grundlage der wirtschaftlichen Entwicklung einer Gesellschaft. Die Einführung eines sicheren Landtitelsystems wird als eines der Schlüsselelemente der wirtschaftlichen Entwicklung angesehen. Im Jahre 2000 hat das United Nations Human Settlements Programm (UN-Habitat) eine globale Kampagne für sichere Eigentumstitel gestartet. Die sicherere und effiziente Übertragung von Grundstückseigentum ist nicht nur für Entwicklungsländer, sondern auch für Industrieländer ein wesentliches Erfordernis. Die internationale Immobilien- und Finanzmarktkrise zeigte, dass die fehlende Legalitätskontrolle bei der Übertragung von Immobilien und bei der Bestellung von Hypotheken und Defizite bei der Landregistrierung schwerwiegende ökonomische Konsequenzen haben können. Der Beitrag untersucht die Sicherheitsmechanismen bei der Übertragung von Grundeigentum und vergleicht zwei unterschiedlichen Systeme: Immobilientransaktion per Grundbucheintragung oder Transaktion ohne Eintragung durch einfaches Erfassen von Eigentumstiteln. Es zeigt sich, dass das Grundbucheintragungssystem als Teil der Freiwilligen Gerichtsbarkeit ein wirtschaftlich effizienteres System darstellt. In Ländern, in denen Immobilientransaktionen einer Legalitätskontrolle unterworfen sind und in denen effiziente Veröffentlichungs- und Registrierungsstrukturen durch Grundbücher und Register bestehen, sind betrügerische Aktionen wie ‘Immobiliendiebstahl’ oder Hypothekenbetrug, die in den Vereinigten Staaten ein großes Problem darstellen, fast nicht vorhanden.
