LAW REPORTS A Civilian Massacre Editor's Note This is probably the first complete English version of the judgment in the Kafr Qassem case. The importance of this judgment is manifested in at least two of its aspects. The first is the aggressive and racist tendencies of the Israeli BorderForce, which became very apparent in the hearings. These tendencies could not have developed without certain systematic indoctrination within the military establishment. The murderers boasted when they mas- sacred the men, women and children: "Many (Arabs) less". It is this same genocidal drive that helped in the pre-state civilian massacres, like that ofDeir Yassin, 1948, and underlined the post-state terrorism, like the Sabra and Shatilla massacres in Beirut in 1982. The District Court highlighted this fact when it said: "There is no need to waste words on the fact that when he gave his order, Malinki knew that the returnees to the villages would be exclusively of the Arab race, and we assume with certainty that had they not been Arabs the order would not have been issued with such severity...... In fact, Malinki gave the order out of contempt for the lives of the Arab residents".
