Corte di Cassazione (Sezioni Unite penali), 24 June 1998 Mistretta and Peralta The entry into force on 2 October 1983 of the International Convention for the Prevention of Pollution by Ships, adopted in London on 2 November 1973, and of the related Protocol, adopted in London on 17 February 1978, which are considered as one legal instrument (the so-called MARPOL 73/78), has brought before the Italian courts a peculiar problem concerning the compatibility of international treaty rules with national laws governing this subject (for the text of the MARPOL Convention, see ILM, 1973, p. 1319). Italy has ratified and implemented the MARPOL Convention and Protocol with Law No. 662 of 31 December 1980 and Law No. 438 of 4 June 1982, respectively.
