SPAIN Sp.2 Advances on wages — no entitlement in respect of elements of remuneration payable at intervals longer than one month HEADNOTES Facts 1. The UGT trade union section of an Economic Interest Group submitted an industrial dispute to the High Court of Catalonia. It sought a declaration that the workers of the Group were entitled to obtain advances on wages, on account of work already performed, both as regards monthly remuneration already earned and as regards the part similarly earned of payments due at intervals longer than one month. The latter payments in the defendant Group were provided for in articles 39, 40 and 41 of the applicable collective agreement and were: - a so-called productivity bonus (article 39), payable once a year with the monthly wage for April of the year following that in respect of which it was earned; - four special payments (article 40) which were due, respectively, with the wages for June, August and October and during the first fortnight in December and the total amount of which was fixed for each wage level in Appendix II of the agree- ment ; - profit-related pay (article 41 ) due with the monthly wage for February http://www.deepdyve.com/assets/images/DeepDyve-Logo-lg.png International Labour Law Reports Online Brill
