Employment contract ― wages ― non-discrimination ― equal treatment HEADNOTES Facts Koneurakointi Osa R. Torppavirta (later known as Osan Kone Oy) as a con- tractor and Saastamoinen Oy as an orderer agreed about the management of a machine and lorry works at the Siikaniemi industrial area (Kuopio sawmill) from 1985 on. Nine employees of Saastamoinen Oy continued working as old employees with the old payment system on the basis of piecework. All the new employees hired after 1985 were paid on the basis of an hourly wage, since the sawmill was also charged on the same basis. A worked at the sawmill from 1999 to 2001 as a lorry driver. His wage was based on the work done per hour regardless of the amount of work. Two other employees had the same payment system as A, but two of the workers were "old" ones and were paid the piece- work rate. The old payment system resulted in a higher average wage per hour than the hourly system. A considered the two different payment systems dis- criminatory and that the employees were treated unequally.
