Qatar 1 SOURCES OF LAW, JUDICIAL AND LEGAL SYSTEM Qatar is an independent State. The provisional Constitution was founded in 1971 and was amended in 1972. It establishes Qatar as an independent sover- eign Arab State and expressly declares Islamic Shari(a law as the principal source of Qatari law. Shari`a law comprises a comprehensive body of legal doctrines formulated by Islamic scholars over centuries from Qur'an and the statements and examples of the Prophet Muhammad. Since independence in 1971 the Government of Qatar has issued Laws and Decrees which form the primary source of the Qatari legal system. Qatari law has been influenced by Egyptian law and other Arab jurisdic- tions. Recently, the Qatari legislature in the Government and in the Majlis al- Shura (Advisory Council) has been considering the needs and realities of Qatari society and economy in the drafting of such legislation. The Qatari system does not formally use judicial precedent from the Qatari Courts as a basic source of law. However customs and traditions form a source of law in certain basic areas. Judges usually seek the guidance of these customs and traditions in their interpretations of Laws.
