Malaysia * CONSTITUTIONAL AND ADMINISTRATIVE LAW Statutory Bodies (Discipline and Surcharge) Act 2000 The Statutory Bodies (Discipline and Surcharge) Act 2000 provides for provisions concerning disciplinary proceedings applicable to officers of statutory bodies incorporated by the law of Malaysia. This Act also governs the procedures to terminate the service of an officer of a statutory body. 1.2 Emergency (Essential Powers) Act 1964 (Revised 2008) The Federal Constitution of Malaysia provides that the head of state, the Yang di-Pertuan Agong is authorized to make proclamations on the existence of a state of emergency. The Emergency (Essential Powers) Act 1964 (Revised 2008) gives power to the Yang di-Pertuan Agong to make any regulations for the purpose of securing the safety of the public, maintaining public order and defending the country upon the declaration of a state of emergency. This includes the authority to promulgate provisions concerning the apprehension, trial and punishment of persons that breach the said regulations. SOURCES OF LAW: JUDICIAL AND LEGAL SYSTEM Energy Commission Act 2001 The Act provides for the establishment of the Energy Commission that is vested with the power to regulate the supply of energies in Malaysia and to enforce laws concerning energy supply.
