This paper was written because of the Criminal Law ERAMUS-Program at Tilburg University, Tilburg, the Netherlands. INTRODUCTION T h e alternative measures to detention have been introduced in Italy by Act 1975 n. 354 which reformed the penitentiary system (and has been since modified by Act 1986 n. 663). Before the Reform Act of 1986, the so called "Act Gozzini", alternative measures provided by the penitentiary system were the entrusting to the social service, semi-liberty and early release. The 1986 Act with the purpose of satisfying the needs of special prevention, not completely realized by the first Reform Act of 1975, has innovated the field of the alternative measures to a great extent. In fact, on the one hand, it has provided new measures, and on the other hand it has extended the possibility of applying already existing measures. The field of alternative measures, in fact, has become rich not only with the provision of a particular kind of entrusting to the social service for alcohol and drug addicts and domiciliary detention, but also the introduction of special leaves.
