Der Schlusssatz spielte in der Diskussion um den privaten oder öffentlichen Hintergrund der Interdikte eine bedeutende Rolle 1 . Nicht minder reizvoll und hier im Vordergrund steht das ‘ maris proprium ius ’, dessen Ausübung durch das interdictum uti possidetis geschützt wird. In der Interpretationsgeschichte von D. 47,10,14 haben die Venezianer maris proprium ius auf der Ebene des Staats- und Völkerrechts gesehen und darunter ihre Jurisdiktion über das Meer verstanden, die sie durch longa consuetudo er- worben haben 2 . Diese Deutung ist freilich singulär geblieben, denn als Träger des maris proprium ius wird durchwegs ein Einzelner (und nicht der Staat)
