169 12 hrcd [ 2001 ] DALLOS v. HUNGARY Right to a fair trial – no violation Article 6, Sections 1 and 3 Supreme Court, which had the power to replace the applicant’s conviction with an acquittal, reviewed the case and the applicant had the opportunity to defend himself before the Supreme Court in relation to the reformulated charge. In a judgment delivered on 1 March 2001 in the case of Dallos v. Hungary , the European Court of Human Rights held unanimously, that there had been no viola- tion of Article 6 (right to a fair trial) of the European Convention on Human Rights. 1. Principal facts The case concerns an application brought by Zoltán Dallos, a Hungarian national, born in 1949 and living in Vonyarcvashegy, Hungary. The applicant was convicted of aggravated embezzlement. He appealed to the Regional Court, which upheld the conviction and sentence, but reclassified the offence as aggravated fraud. The court held that the facts outlined in the indictment constituted this offence. The applicant lodged a petition for review with the Supreme Court which, after hearing an address by the applicant’s lawyer at a public session, upheld the conviction. 2. Procedure of the
