75 11 hrcd [ 2000 ] ROWE and DAVIS v. the UNITED KINGDOM JASPER v. the UNITED KINGDOM FITT v. the UNITED KINGDOM Right to a fair trial – violation Article 6 Where the prosecution, without the knowledge or approval of the judge, decided that evidence not be disclosed to the defence because of the public interest, the Convention was violated. In a judgment delivered on 16 February 2000 in the case of Rowe and Davis v. the United Kingdom , the European Court of Human Rights held unanimously that there had been a violation of Article 6 (right to a fair trial) of the European Convention on Human Rights. In two further judgments delivered on the same day in the cases of Jasper v. the United Kingdom and Fitt v. the United Kingdom , the Court found no violation of Article 6 . The Court made an award of costs in the case of Rowe and Davis . 1. Principal facts The cases concern three applications brought by four British nationals.
