COUNCIL OF EUROPE Additional Protocol to the Convention on human rights and bio- medicine concerning biomedical research, Council of Europe, 2004. The Protocol on biomedical research, recently opened for signature, is an important milestone in the international protection of individuals participating in biomedical research. Since the first guidelines in this field, the Nuremberg rules of 1947, advances in scientific knowledge clearly have changed the orientation and scale of research. The international dimension of research involving individuals (multi- centre trials) has gained much in importance. In medical science, the so called experimental research in particular has ex- panded enormously. The more biomedical research is carried out, the more the risk for tension between the interest of the research and human rights. Those rights need protection. The more so where the research is not primarily for the interest of the participant in the research. The structural presence of third party interests makes the participant vulnerable for abuse. Freedom of biomedical research is limited by the fundamental rights of individuals participating in the research.
