© Koninklijke Brill NV, Leiden, 2001 Islamic Law and Society 8,3 THEME ISSUE: ¼ADÁTH AND FIQH GUEST EDITOR: SUSAN SPECTORSKY Joseph SchachtÕs outline of the relationship between ½adÂth and fiqh has dominated Western scholarship since the publication of his Th e Origins of Muhammadan Jurisprudence in 1950. Schacht, however, made no reference to several important ½adÂth collections and f iqh works that had not yet been published. For example, he ignored the mu × an na f s of ®Abd al-Razz¨q and Ibn Ab Shayba and gave only scant attention to the ½adÂth collections of Im¨m Sh®ism. With the publication of these and other texts, scholars have begun to re-examine the relationship between ½adÂth and fiqh and to move beyond SchachtÕs outline. Three of the four studies presented in this theme issue of ILS — Gautier JuynbollÕs, Christopher MelchertÕs and mine — are on ½adÂth and Sunn jurisprudence; Robert GleaveÕs is on ½adÂth and Im¨m jurisprudence. All of them incorporate sources that were not used by Schacht. In his earlier studies of ½ a d  t h criticism, Juynboll has taken SchachtÕs theory of the Òcommon linkÓ as a starting point.
